Ireland’s first dedicated rules for nicotine pouches moved a concrete step forward this week. According to the Oireachtas bill page for Bill 36 of 2026 (last updated 14 October 2026), the Public Health (Tobacco Products and Nicotine Inhaling Products) (Amendment) Bill 2026 is now before Seanad Éireann at Third Stage — Committee Stage, when the bill is examined section by section.

It is not yet law. Enactment still needs the remaining Seanad stages and the President’s signature, and individual measures are typically commenced later by ministerial order.

The bill cleared the Dáil without amendment in June. In the Seanad Second Stage debate on 22 September, Minister of State Jennifer Murnane O’Connor said the bill had been notified to the EU under the technical standards directive, that the standstill period ended on 7 October 2026, and that it was her intention to enact the bill as soon as possible after that.

What the bill would do to nicotine pouches

When the Government approved the proposals in March, the Department of Health said the bill will:

  • Prohibit sale of “nicotine consumption products” such as pouches to anyone under 18
  • Prohibit advertising of nicotine inhaling products and nicotine consumption products in all retail outlets
  • Prohibit point-of-sale display of those products in mixed retail outlets
  • Create a future-proofed category so new recreational nicotine products fall under the same baseline youth-protection rules

The Irish Examiner reported the same package when Cabinet agreed the bill on 3 March 2026.

Most of the bill’s packaging, colour and flavour restrictions target nicotine inhaling products (vapes), not pouches. In the Seanad debate, Senators flagged that flavour and colourful-packaging rules for pouches are narrower than for vapes; the Minister of State pointed to EU timing and the forthcoming Tobacco Products Directive revision as reasons not to widen pouch packaging measures in this bill.

What it does not do (today or as drafted)

  • It does not ban adult purchase or possession of nicotine pouches.
  • It does not, on the public record of this bill, set a nicotine strength cap or a flavour ban for pouches.
  • Until the bill is enacted and commenced, Ireland still has no pouch-specific statutory age-of-sale rule — a gap RTÉ highlighted in June 2026 when reporting the rise of tobacco-free pouches (often called “snus” in Ireland).

Why this matters for adult buyers in Ireland

  1. In shops: once commenced, open display in mixed retail and in-store advertising of pouches would be restricted — similar in spirit to how tobacco is kept out of sight, though the exact commencement dates are not set yet.
  2. Online / distance sales: the March Department of Health summary focuses on retail advertising and point-of-sale display. Treat any online rules as whatever the final Act and commencement orders say — check the Oireachtas bill page rather than assuming.
  3. Age checks: an explicit under-18 sales ban for pouches would align Irish statute with practice many retailers already claim to follow, and with the UK’s forthcoming UK-wide age-of-sale rules for nicotine products from 29 October 2026 (separate UK law).

Background: why Ireland is acting

RTÉ (7 June 2026) reported that tobacco-free nicotine pouches became popular in Ireland around 2022–2023, are widely available and advertised, and that sales of one brand increased nearly five-fold in a year. Because the products contain no tobacco leaf, they have sat outside older tobacco advertising and age rules — the gap this bill is meant to close for youth access and visibility.

Minister Carroll MacNeill framed the package as limiting promotion and sale of addictive products; Minister Murnane O’Connor stressed future-proofing so a new law is not needed each time a new nicotine format appears (gov.ie).

What happens next

  1. Finish Seanad Third Stage (Committee), then Fourth and Fifth Stages.
  2. Presidential signature → enactment.
  3. Commencement orders for specific measures (dates may differ).
  4. In parallel, the EU is preparing Tobacco Products Directive / advertising revisions that could later add EU-wide pouch rules — Ireland’s ministers have said they want common EU standards.

FAQ

Is the bill law yet?
No. As of 14 October 2026 it is at Seanad Third Stage and has not been enacted.

Will adults still be able to buy nicotine pouches in Ireland?
The published proposals regulate youth sales, advertising and display. They do not ban adult use. Always follow the law as commenced.

Do flavour and plain-pack rules apply to pouches in this bill?
The Department of Health list applies colour, imagery and flavour limits to nicotine inhaling products (vapes). Pouch measures in the March announcement are the under-18 ban plus retail advertising and mixed-outlet display bans.
