On 29 October 2026, the first big wave of the UK's Tobacco and Vapes Act 2026 comes into force, and nicotine pouches are named directly in a UK-wide age-of-sale rule. As Vending Times reported on 20 October, citing a government press release, the change brings pouches and other nicotine products that were previously exempt from certain restrictions under the same age-verification rules as vapes.
This explainer sums up what changes, what it means if you are an adult who buys pouches in the UK, and where the law goes next. Everything below comes from the official GOV.UK guidance and the reporting linked in the sources.
What changes on 29 October 2026
According to the Department of Health and Social Care guidance Selling vaping and nicotine products, from 29 October 2026:
- Age of sale is 18 for all vaping and nicotine products. Selling them to anyone aged 17 or under becomes an offence, and that explicitly includes online retailers.
- Proxy buying is banned. It becomes an offence for anyone aged 18 or over to buy, or attempt to buy, vaping or nicotine products on behalf of someone under 18.
- Free giveaways are banned where the purpose or effect is to promote the product.
- Substantial discounts are banned where the purpose or effect is to promote the product.
- Promotional coupons are banned, whether given away or sold at a substantial discount.
Vending Times notes that ordinary price reductions are not automatically prohibited; whether a discount crosses the line depends on its size and purpose.
A separate GOV.UK guidance page confirms a ban on vending machines that sell or dispense tobacco, vaping or nicotine products to customers, also from 29 October 2026. A narrow exemption remains for vaping machines in inpatient areas of adult mental health hospitals in England and Wales.
Which products count as nicotine products
The guidance lists, among others:
- Nicotine pouches, described as tobacco-free pouches containing nicotine powder placed between the gum and lip
- Nicotine strips, dissolvable films placed on the tongue or between the gum and lip
- Nicotine pearls, small dissolvable balls that dissolve under the tongue
All types of nicotine are in scope, including synthetic nicotine made in a lab. Medicinal products and medical devices are excluded.
What it means for adult buyers in the UK
- Expect to prove your age. The guidance says retailers, online retailers included, must be satisfied a customer is 18 or over before a sale, and customers should expect to show ID if asked.
- No free samples or promotional coupons. Promotional giveaways and coupons for nicotine products become offences.
- Big promotional discounts go away, normal pricing stays. Substantial promotional discounts are banned, but ordinary price reductions are not automatically illegal.
- No vending machines that sell or dispense nicotine products to customers.
- Buying for someone under 18 is an offence. Under the fixed penalty notice guidance, trading standards in England and Wales can issue fixed penalty notices for proxy purchasing, and the old £90 proxy-purchase notice is replaced by a new £200 one from 29 October.
Enforcement
In England and Wales, trading standards can issue fixed penalty notices from 29 October 2026 for selling vaping or nicotine products to under-18s, proxy purchasing, promotional giveaways and substantially discounted promotional sales, among other offences. The guidance says selling to someone under age may also lead to prosecution.
Background: the Tobacco and Vapes Act 2026
The Tobacco and Vapes Bill received Royal Assent on 29 April 2026. Its best-known measure, the generational smoking ban, follows on 1 January 2027, when it becomes illegal to sell tobacco to anyone born on or after 1 January 2009, according to the government's guidance collection.
Vending Times adds that the 29 October changes follow a vaping liquid tax introduced on 1 October, and that further rules on packaging, flavours, product displays and retail licensing could follow as other parts of the Act are implemented.
The bottom line
Nicotine pouches stay legal for adults in the UK. What changes on 29 October 2026 is that the rules around them now look much more like the rules for vapes: 18+ everywhere including online, age checks, no promotional freebies, coupons or substantial promotional discounts, and no vending machines. The Pouchstore.com journal tracks nicotine pouch regulation across Europe and the UK.
Nicotine is addictive. Nicotine pouches are for adults aged 18 and over only.
